§ 1 General information

(1) The use of the services offered by ipso-ecare.com is governed by the present General Terms and Conditions. Different agreements must be in writing

§ 2 Scope of services

(1) ipso-ecare.com offers an online platform where support for psychosocial problems is offered to registered clients in a login-protected area. After registering the client can perform a first self-assessment online. Afterwards it is possible to arrange an online consultation with one of the volunteer consultants.

(2) Registration with ipso-ecare.com is free of charge for the client.

(3) ipso ecare.com does not record the talks within the framework of the consultation. For quality control, the client is asked to fill out an evaluation form after the appointment.

(4) ipso-ecare.com does not provide psychotherapeutic services. Neither the use of ipso-ecare.com nor the agreement of online consultations with a counselor replaces a necessary psychotherapeutic treatment. Look for a psychotherapist in your area or, in urgent cases, an emergency ambulance. Special professional legal provisions and restrictions apply to medical care on the Internet. The range of services is therefore limited to the current legal options. Special notes on the specification and performance are binding.

§ 3 Registration

(1) The use of ipso-ecare.com requires the establishment of a client-specific account for which registration is required. The registration requires that the client transmitts all requested informations on the login screen truthfully and completely to ipso-ecare.com. When registering, the client must have unlimited legal capacity and has to be at least 18 years old. During registration, the client will be asked to accept the Terms and Conditions and the Privacy Policy.

(2) After registration, an email with a confirmation link is sent to the email address specified by the user during registration. This link has to be clicked to activate the account. If the account is not activated within two weeks after the registration process, it will be discarded and the informations will be deleted. With the activation of the account a user agreement is concluded in accordance with the Terms and Conditions.

(3) There is no legal entitlement to the services provided by ipso-ecare.com. ipso-ecare.com is entitled to refuse registration without giving reasons.

§ 4 Cancellation terms

Right of withdrawal:

You have the right to cancel this contract within fourteen days without giving any reason. The revocation period is fourteen days from the date of contract conclusion.

by means of a clear statement (eg. a letter consigned by post mail, fax or email) of your decision to withdraw from this contract.
In order to observe the revocation period it is sufficient for you to send the message about the exercise of withdrawal before the withdrawal time limit.
Effects of withdrawal:
If you withdraw from this contract, we have to repay you any payments we have received from you without delay within fourteen days from the date on which the notification about your cancellation of this contract with us is received. For this repayment, we use the same method of payment that you used in the original transaction, unless you explicitly agreed otherwise; you will not be charged fees for such repayment in any case.
In case you had required that the services are to begin during the withdrawal period, you have to pay us a reasonable amount in the share of services rendered, compared to the total amount provided in respect of this contract, up to the date on which you notify us of the right of cancellation,.

§ 5 Information duties

(1) There is no non-judicial grievance- or appeal procedure, ipso ecare.com is subjected to.

(2) All other information about ipso ecare.com, the offer and the settlement can be taken from the explanations on www.ipso-ecare.com.

(3) Regarding the technical steps for contract conclusion  § 3 of these terms and conditions is to be observed.

(4) The client can save the contract text by saving the website in question on his computer using the "Save As" function of his browser . He also has the option to print the contractual text by using the print function of his browser. ipso-ecare.com itself does not store the contract texts.

(5) The client can correct his inputs during the registration at any time by selecting the "Back" button in his browser and then making the appropriate change. By closing the Web browser, the client may cancel the registration at any time.

(6) The contract is concluded in the respective national language. In Germany in German language.

(7) ipso-ecare.com is not subject to any special code of conduct (rules).

§ 6 Usage rights

(1) The client's rights at the Internet site are exclusively limited to the awards granted under these Terms and Conditions.

(2) The content, information, images, videos, databases published on the online platform  ipso-ecare.com are subject to copyright and usually owned or licensed by ipso-ecare.com.

(3) The content on the online platform may be used or reproduced for personal and not for commercial purposes. A disclosure of the contents is forbidden without the express consent of ipso-ecare.com.

§ 7 Client data

(1) Without the consent of the client, no data is collected, processed, or used. The data collected will be used only with the consent of the client, or used to the extent necessary for the execution of contracts and service fulfillment.

(2) At all times during the availability of the online platform, the client can retrieve the data stored by him in his account to modify or delete.

(3) The online consultations are neither recorded nor stored by ipso-ecare.com.

(4) Reference is also made to the information accessible under the "Privacy policy" button.

§ 8 Availability

(1) The online platform ipso ecare.com is usually available 24 hours a day. Except for the times when ​​backup operations and system maintenance or maintenance work is carried out to the system or the database. ipso-ecare.com will keep any resulting potential disruptions to a minimum.

(2) Consultations are held exclusively by prior appointment via the online platform.

§ 9 Liability

(1) A liability of ipso-ecare.com to damages, especially for delay, non-performance, defective performance or unlawful act exists only for breach of essential contractual obligations, that could be trusted to be fulfilled in particular. In addition, a liability of ipso-ecare.com is excluded, unless there are a compelling legal regulations. The disclaimer does not apply to intent and gross negligence.

(2) ipso-ecare.com is only liable for foreseeable damages. Liability for indirect damages, including consequential damage, unforeseeable damage or untypical damage as well as lost profits is excluded. The same applies to the effects of labor disputes, accidental damage and force majeure.

(3) The foregoing limitations of liability apply to all contractual and non-contractual claims.

§ 10 Obligations of the client

(1) The client may only use the services properly. He will in particular hold his username and password to confidential access and not give, tolerate or permit any acknowledgment and shall take the necessary measures to ensure the confidentiality and notify the company in case of loss or misuse of this information or any suspicion.

(2) The client is obliged to give anyinformation required for the provision of the services properly, fully and truthfully.

§ 11 Blocking access / cancellation

(1) ipso-ecare.com reserves the right to investigate in case of suspected improper use or fundamental breach in order to take appropriate precautions and to terminate the client's access in case of founded suspicion. If the suspicion can be overcome, the blocking will be cleared, otherwise ipso ecare.com has an exceptional right of termination.

(2) Each party has the right to terminate the contract at any time. The cancellation by the client can be carried out via e-mail or by clicking the "Termination" button in the log-in area. Termination by ipso-ecare.com is possible only by e-mail. The termination shall take effect upon receipt of the notice. At the effective date of termination the client's access to the online platform of ipso-ecare.com will be locked.

§ 12 Modifications

(1) ipso-ecare.com has the right to change the terms and conditions at any time with effect for the future.

(2) An intended amendment of these terms and conditions shall be communicated to the registered clients via e-mail to the last email address the client has given to ipso ecare.com. The respective change will take effect, if the respective client does not object within two weeks after sending the email. For compliance with the two-week deadline the timely sending of the opposition is decisive.

(3) Should the client contradict the change within the two-week period, ipso ecare.com is exceptionnaly entitled to terminate the contractual relationship entirely without notice, without that any claims against ipso ecare.com arise for the client. If the contract is continued after the effective opposition of the client the existing terms and conditions retain their validity.

§ 13 Final clauses

(1) German law applies.

(2) Should individual provisions of these terms and conditions, including this provision, be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. Instead of the invalid or missing provisions, the respective legal regulations apply.
